Key points
Under Ontario's Employment Standards Act, 2000, what matters is the actual relationship between the individual and the business, not the label given to it.

The Act's business consultant exception covers people who advise an organization on its performance, including in human resources, but only when all four of its conditions are met.
One condition is a written agreement that sets out when and how much the consultant is paid, expressed as an hourly rate of at least $60.
The Employment Standards Act, 2000 does not apply to sectors under federal jurisdiction, such as airlines, banks and interprovincial railways.

Questions
Senior HR expertise provided for part of the time, on an ongoing basis, instead of a full-time hire. It gives an organization experienced HR leadership without adding another permanent role.
Interim leadership fills a role for a set period, such as a leave, a vacancy or an executive search. Fractional leadership provides senior HR expertise for part of the time, on an ongoing basis.
It can. A growing organization may need practical HR infrastructure before it needs a full-time HR executive, and building HR infrastructure for growing organizations is part of the practice's HR advisory work.
As long as the need does. Engagements can be project-based, fractional, interim or ongoing, and the scope should fit the need.
