  1. Under Ontario's Employment Standards Act, 2000, when an employee's leave under the Act ends, the employer must generally reinstate them to the position they most recently held if it still exists, or to a comparable position if it does not.

  2. In Ontario, an employer cannot require an employee to return early from pregnancy or parental leave. An employee who wants to return early must give at least four weeks' written notice.

  3. In federally regulated workplaces, an employee returning from maternity or parental leave under the Canada Labour Code is entitled to their former position or, if that is not possible for a valid reason, a comparable position with the same wages and benefits in the same location.

What happens when the permanent leader arrives or returns?

Interim coverage is temporary by design, so it ends with a handover. When the interim role covers a leave, the returning employee's reinstatement rights shape how that handover is planned.

Is interim the same as fractional HR?

Interim leadership fills a role for a set period, such as a leave, a vacancy or an executive search. Fractional leadership provides senior HR expertise for part of the time, on an ongoing basis.
